Terms and Conditions

There are various terms and conditions which you should be aware of when you are registering for the 13th Subud World Congress in Christchurch.  All of these terms and conditions apply to you and to all members of your party who are registering with you.

This Congress is being organised and prepared by Subud World Congress Incorporated.  This is a New Zealand Incorporated Society, and is a Not for Profit Corporation.  It was formed on 30 January, 2008 with Registration Number 2089877. This Society has Founding Members who are primarily the Congress Organising Team.  There is also a Board of Trustees.  The Board has the ultimate legal and financial authority for organising and running the Congress.  Individuals on the Board of Trustees are from the World Subud Association and Subud New Zealand.

In addition to the Founding Members of the Incorporated Society, each person who registers to attend the congress will automatically become an Attending Member of the Subud World Congress Incorporated Society.  This membership will automatically terminate 30 days after the end of the 13th Subud World Congress.

The complete constitution of the Subud World Congress Incorporated Society can be read on the New Zealand government website for Incorporated Societies.  This link is at www.societies.govt.nz.  The constitution delineates and describes the full responsibilities of the Society and all members of that society.  As an attending member, you agree to conduct yourself in an orderly manner and to comply with the laws of New Zealand.

Waiver of Responsibility

You and all members of your party hereby agree that,  as you are coming to the 13th Subud World Congress of our own choice, you are solely responsible for any accidental risks to yourself or any illness that you may suffer while attending the Congress and you and all members of your party will in no way hold Subud World Congress Incorporated of the World Subud Association responsible for such risks or illness.

You and your party shall also be solely responsible for any damages that you may incur, to any of the Venues or to any equipment at those Venues at which the 13th Subud World Congress is taking place.

Neither Subud World Congress Incorporated or the World Subud Association shall be held responsible for theft of any personal belongings at the venues during the Congress.  We strongly recommend that all members attending the Congress take out personal liability and health travel insurance.

By Registering for the 13th Subud World Congress you and all members of your party agree to all of these terms and conditions and to the Waiver of Responsibility.

Conduct

You and all members of your party who are registering with you, including your guests, agents and representatives (herinafter referred to as your party) and attending this 13th Subud World Congress (the Event) must conduct themselves in an orderly manner, in full compliance with the applicable laws of New Zealand, and comply and ensure compliance by all persons in your Party in attendance with the same and with all reasonable directions of the Management of the Venues or Officers and Agents of Subud World Congress Incorporated.  You and your Party must ensure no disturbance or nuisance will be caused to any of the Venues or any of its guests, visitors or neighbours. The Venues are Christchurch Convention Centre, Christchurch Town Hall, Cathedral Grammar School, Caledonian Hall, Unlimited Paenga Tawhiti High School, and any other locale at which the Event is conducted. The Management of the Christchurch Convention Center and Town Hall or an officer of the Subud World Congress Incorporated are entitled to remove any person from the Event whose behaviour, in the opinion of either the Management of the Venues or the Subud World Congress Incorporated, is objectionable, improper or undesirable.

Indemnity and Hold Harmless

You and your party assume the entire responsibility for any and all losses, damages, claims, demand and expenses (including, but not limited to, attorney fees) arising from, alleged to have arisen from, or in any way connected with (a) injury or damages to displays, equipment and other brought to the Venues by you and your party thereof; and (b) injury to any other person or damage to any property arising out of or in any way connected with (1) any action of you and your party or (2) any property you and your party are responsible for brought onto the premises of the Venues.  You and your party shall indemnify, defend and hold harmless all of the Venues, Subud World Congress Incorporated, the World Subud Association, its owners, officers, affiliated entities, agents, servants and employees from any and all such losses, damages, claims, demands and expenses.

Damage to Venues

You and your party will be responsible for all damages caused to any of the Venues of the 13th Subud World Congress by you and your party in attendance at the Event (other than those under the control or direction of the Venues) or any contractors engaged by your or your Party for the Event and must immediately pay to the Venues the costs of rectification of any damage.

Release of any Future Claims

In consideration of permitting the below named Registrants to participate in the 13th Subud World Congress in Christchurch, New Zealand, beginning on the 4th day of January, 2010 and ending on the 18th day of January, 2010, the Registrant, for himself/herself, his/her heirs, administrators or executors, hereby voluntarily releases, discharges, waives and relinquishes any and all actions or causes of action for personal injury, property damage, or wrongful death occurring to him/herself arising as a result of engaging or participating in any sponsored 13th Subud World Congress activity or activities incidental to any Subud World Congress programs or events.

It is the intent of the named registrant to exempt and relieve the Subud World Congress Incorporated, Subud World Congress Incorporated Employees, Subud World Congress Incorporated Directors, Volunteers of the Subud World Congress Incorporated Society, Subud World Congress Incorporated Officers, Subud World Congress Incorporated Employees, the World Subud Association, the World Subud Association affiliates, World Subud Association Employees, World Subud Association Directors, from liability for personal injury, property damage or wrongful death caused by negligence of the Subud World Congress Incorporated, Subud World Congress Incorporated Employees, Subud World Congress Incorporated Directors, Volunteers of the Subud World Congress Incorporated Society, Subud World Congress Incorporated Officers, Subud World Congress Incorporated Employees, the World Subud Association, the World Subud Association affiliates, World Subud Association Employees or World Subud Association Directors.

The named registrant for himself/herself, his/her heirs/executors, administrators agrees that in the event of any claim by the named registrant for himself/herself his/her heirs, executors, or administrators for personal injury or wrongful death or property damage shall be prosecuted against Subud World Congress Incorporated, Subud World Congress Incorporated Employees, Subud World Congress Incorporated Directors, Volunteers of the Subud World Congress Incorporated Society, Subud World Congress Incorporated Officers, the World Subud Association, the World Subud Association affiliates, World Subud Association Employees or World Subud Association Directors, shall indemnify and render non-liable the Subud World Congress Incorporated, Subud World Congress Incorporated Employees, Subud World Congress Incorporated Directors, Volunteers of the Subud World Congress Incorporated Society, Subud World Congress Incorporated Officers, the World Subud Association, the World Subud Association affiliates, World Subud Association Employees or World Subud Association Directors from any and all claims or causes of action by the named registrant for himself/herself, his/her heirs, executors, administrators made or presented for personal injuries, property damage or wrongful death.

By filling out the application form, all Registrants acknowledge that they have read and agreed to the foregoing paragraphs of the Terms and Conditions.
